Terms

These are the terms for using ClassMetrix. They are written to be read, not skimmed past. If anything is unclear, email hello@classmetrix.app before you start.

Who we are

ClassMetrix is run by 123teq LLC, a limited liability company registered in Wyoming, United States ("we"). You are the studio, school or business that opens a ClassMetrix account ("you"). The person who opens the account confirms they are allowed to agree to these terms for that business.

What ClassMetrix is, and is not

  • ClassMetrix is web software for running drop-in classes: checking people in, recording how they paid, keeping passes, costs and teacher pay straight, and reporting what each class earns.
  • It records payments. It does not take them. Your card terminal and your cash tin take the money. ClassMetrix never holds card numbers and never moves money, to you, from you or to your teachers.
  • Its reports are each class's takings minus the costs you enter. They are not your business accounts, your tax return or financial advice. Check them against your own records before you rely on them.
  • It has no bookings, class limits, waitlists or automatic memberships, and we don't promise to add them.

Your account and your staff

  • You decide who on your staff can sign in and what each person can see. You are responsible for what they do in your studio's account.
  • Keep sign-in details to yourself. Tell us straight away if you think someone else has them.
  • You must be at least 18 to open an account.

Your students' information

  • What you collect about your students, and why, is your decision. You must have the right to collect it and to give it to us to hold for you.
  • Your waiver and code of conduct are yours. We supply a starting text as a convenience, not as legal advice. Have your own checked.
  • We hold your students' information for you, use it only to run ClassMetrix for you, and never sell it. The privacy page says exactly what is held, where, and for how long. It is part of these terms.
  • If a student asks you to see, fix or delete their information, you can do most of it in the app. Email us for the rest and we will help.

The free trial

  • Your first 30 days are free. The trial includes everything, and we don't ask for a card.
  • Before the 30 days are up we email you. You pick a plan, or you stop. Nothing is charged automatically.
  • If the trial ends and you haven't picked a plan, your account becomes read-only. We keep your records for 30 days so you can download them, then we may delete them.

Plans and paying

  • The plans and prices are on the pricing page. Your plan follows the number of classes on your weekly timetable. Students, check-ins, staff logins and venues are never counted.
  • Studios in Australia pay in Australian dollars, with GST included. Studios everywhere else pay in US dollars.
  • You pay monthly or yearly, in advance. We send an invoice or a payment link; nothing is charged without your say-so.
  • A new class doesn't count towards your plan for its first 8 weeks. If you go over your plan's limit, nothing changes at the door; we tell you, and your plan changes at your next bill.
  • You can move to a smaller plan at any time. Parts of the app not in that plan are hidden, not deleted. The price you join at is held for 24 months. You can pause for up to two months a year at no charge, with your records open to read.
  • If a bill is overdue we remind you. If it stays unpaid for 30 days after that, we may make your account read-only until it is paid.

Your records are yours

  • Everything you and your students put into ClassMetrix stays yours. You give us permission to store and process it, only so we can run ClassMetrix for you.
  • The owner can download the student list and every check-in as a spreadsheet file at any time, on every plan.
  • When you leave, tell us and we delete your records within 30 days, apart from what the law makes us keep (for example, invoices). You may need to keep your own copy of signed waivers for your own records; download them first.

Fair use

Use ClassMetrix for running your own classes. Don't use it to break the law, to collect information about people you have no business with, to send unwanted messages, or to probe, overload or copy the service. We may suspend an account that does, after telling you, or at once if we have to.

Keeping it running

  • We aim to keep ClassMetrix available all the time and to tell you when it isn't. We don't promise it will never be down or never have a fault. If something goes wrong at the door, record it on paper and enter it afterwards.
  • We back up your records and keep them separate from every other studio's. Only your staff can see them.
  • We may change or improve ClassMetrix. If we remove something you rely on, we tell you first and give you time to adjust.

What we are responsible for

  • If ClassMetrix fails you, our responsibility is limited to the amount you paid us in the 12 months before the problem. We aren't responsible for lost takings, lost students or other indirect losses.
  • Nothing here takes away rights the law gives you that can't be signed away, including under the Australian Consumer Law if you are in Australia.
  • You are responsible for your use of ClassMetrix, for what you tell your students, and for the prices, waivers and pay deals you set up in it.

Ending

  • You can stop at any time by emailing us. If you have paid for a year, we refund the months you haven't used.
  • We can end your account if you break these terms or don't pay. Apart from an emergency, we give you 30 days' notice first, and you can download your records in that time.
  • If we ever close ClassMetrix down, we give every studio at least 90 days' notice and a way to get its records out.

Changes to these terms

When these terms change, we post the new version here with a new date. If a change matters to you, such as a price or a right, we email the account owner at least 30 days before it applies. Using ClassMetrix after that date means you accept the change.

Which law applies

These terms are governed by the law of Wyoming, United States, except where the law of the place you live gives you rights that can't be taken away, which you keep. If we have a dispute, we talk first. Email us and we will try to sort it out within 30 days before anyone goes further.
